Terms of sales

The materials delivered or services (training, maintenance, rental …) provided by the company AXSOL are subject to the Conditions set out below.  Any derogation must be the subject of a written stipulation and must be expressly accepted by us.

PRICES:

valid for 3 months, and then updatable or revisable, according to the regulations in force.  The price fixed in the estimate is net and includes, depending on the case, the quantity, the cost of study leading to its realization, the custom manufacturing, the supply of the equipment.

ORDERS:

the acceptance of quotation is worth firm and final order subject to the payment of the anticipated deposit.  The private customer has the right to cancel the order, within 10 (ten) days, including holidays, from the order or purchase commitment, by registered letter with acknowledgment of receipt.  If this period normally expires on a Saturday, Sunday or a holiday or holiday, it is extended until the next business day.
After this time, some equipment being personalized, the purchase is definitive and payable in full settlement.  Authorizations and prior or subsequent approvals must be requested by you, especially from tenders, administrations and control offices.  On another hand, the Director of AXSOL company reserves the right to cancel this order in the case of specific configuration or following the refusal of earning the manufacturer (not approval of plans).

CANCELLATION:

In case of cancellation of the service order (in particular rental) at the customer’s initiative for any reason (at the end of the legal period of 10 days for individuals), compensation corresponding to 50% of the amount of the Benefit will be due to AXSOL if the cancellation occurs more than 8 days before the beginning of the rental. The compensation will be 100% if amount of the benefit in the cancelation occurs less than 8 days before beginning of the rental.

RESERVATION OF PROPERTY:

“All goods delivered remain the property of the company AXSOL until full payment.  (80.335 Act of 12-05-80). “However, the responsibility is transferred from the delivery. The property reserves the dealer to dealer to its user customer will benefit in priority 1 to the seller, if full payment has not intervened between the 1st seller and the dealer’s dealer.

DEADLINES:

The indicated deadlines take effect from the reception of the written order.  We are automatically released from all commitments relating to delivery times, without payment of compensation of any kind whatsoever    :

  1.  In the case where the terms of payment have not been observed by the buyer.
  2. If any preparatory work at the expense of the buyer is not carried out.
  3. In case of force majeure    strike, fire, flood, shortages of raw material or energy, etc.
  4. If the date of receipt   confirmed by AXSOL is rejected by the customer, the device will be considered as delivered and will therefore be part of the price of the delivery must be paid immediately to AXSOL.  Then a custodial fee of € 20 will be charged to the customer weekly.

GUARANTEE:

In any case, the legal warranty applies to the installed equipment.  Unless otherwise specified, the equipment has two (2) years parts and labor.  Interventions under the guarantee cannot have the effect of extending the duration of the guarantee.  Under this warranty, the sole obligation of the seller is the free replacement or repair of the equipment or defective item by his services.  Defects and deteriorations caused by natural wear, external accident, vandalism, mishandling or by a modification of the installation not foreseen nor specified by the salesman, are excluded from the guarantee.

BILLING:

The invoice, issue on the shipping day is due immediately.  In default of payment, after formal notice by registered letter with acknowledgment of receipt, the buyer shall be automatically liable for a penalty for late payment calculated on the totality of the sums remaining due, by applying a penalty rate 12%/year.
For professionals and communities, a lump sum compensation for recovery costs of 40 euros will be charged to the customer, in accordance with Articles L441.3, L441-6 and D441-5 of the French Commercial Code (as amended by the law n ° 2012-387 of March 22nd, 2012), in case of delay or default of payment.  In the event of a regulatory amendment, the amount of this indemnity will be automatically modified.

DELIVERY:

The delivery of the goods is on the ground floor or at the dock.  In any case the seller declines all responsibility if the conditions of access to the site delivered are not adapted to the selected products.  Unit deliveries are provided by unsigned courier services.  If you wish a discount with signature, an additional cost applies.
For rental service: if the customer can’t personally receive or deliver the equipment, he can transfer, under his responsibility, the authorization to sign on his behalf to a third party (eg: hotel concierge)

Delivery is deemed to be made as soon as the carrier takes over from our warehouses or the factories of our suppliers, even in the case of free delivery.

Particular care is taken in the preparation of s control. Packaging are oversized and protected.  Goods and materials travel at the expense, risk and peril of the buyer.  In case of transport damage, and in order to preserve its recourse against the carrier, the customer must formulate written and precise reservations on the carrier’s bill after opening the package in front of the deliveryman.

A large part of our products are in stock permanently.  Thus packages are usually shipped between 48 and 72H after receipt of your payment according to the customer’s request.  We deliver every day of the week, from Monday to Friday.

The deadlines are guaranteed upon receipt of your payment and are expressed in working days, except transport hazards.  If the delivery time is likely to be exceeded or if the product proves unavailable after placing the order, the customer will be notified of the new delivery period before the end of the initial period with a proposal for cancellation and / or refund.  The amount of shipping costs will be displayed upon acceptance of the order sent by e-mail.  All these conditions of transport only apply to deliveries made in Metropolitan France.
